1) Introduction & Acceptance
These Terms & Conditions (“Terms”) govern your use of our website and your participation in treks/expeditions organized by Terranova Exped (“we”, “us”, “our”). By booking or participating, you agree to these Terms and any route-specific notes in your proposal/invoice. If there is a conflict, the signed proposal/invoice prevails.
2) Eligibility
- You confirm you are legally competent to enter a contract. Minors must be accompanied by/obtain consent from a parent/guardian.
- You are responsible for meeting passport/visa/permit requirements for the route.
3) Bookings & Payments
- Deposit & confirmation: A booking is confirmed only after we receive the deposit and issue written confirmation.
- Balance due: As stated in the invoice (typically due 30 days before start). Unpaid balances may result in cancellation per policy.
- Payment methods: Bank transfer/UPI/cards via our payment gateway. Any gateway/FX fees are borne by the payer.
- Documentation: You must submit required IDs/insurance/medical forms before the deadline, failing which participation may be declined without refund.
4) Pricing, Inclusions & Exclusions
Included (typical group departure)
- Leadership/guides, common technical gear, camping arrangements, meals on trek as listed, permits (route-dependent), logistics support.
Not Included
- Flights, personal gear rentals, hotel stays outside itinerary, personal insurance, tips, personal expenses, and anything not specifically mentioned as included.
Exact inclusions/exclusions will be listed on your specific trip proposal/invoice.
5) Health, Fitness & Insurance
- You warrant that you are physically and medically fit for the chosen route and will disclose relevant medical history (allergies, medications, altitude experience).
- We strongly recommend personal travel/medical insurance that covers high-altitude trekking, evacuation, and trip cancellation. Some routes may require proof of insurance.
- You consent to reasonable first-aid and emergency care deemed necessary by our leaders, understanding that remote responses may be delayed.
6) Risks & Safety
Mountain travel involves inherent risks including altitude illness, weather, terrain hazards, remoteness, and transportation issues. By participating, you knowingly accept these risks and agree to follow leader instructions, acclimatization protocols, and gear checks.
7) Equipment & Rentals
- We provide shared technical gear; you must carry personal equipment per checklist.
- Rental items must be returned undamaged. Loss or damage beyond normal wear may be charged at repair/replacement cost.
8) Itinerary Changes & Force Majeure
We may alter the itinerary, camps, or dates for safety, permits, weather, minimum team size, transport closures, natural events, or other circumstances beyond our control. Reasonable alternatives will be offered where possible.
9) Cancellations, Reschedules & Refunds
Cancellations/reschedules are governed by our Refund & Cancellation Policy. Non-recoverable third-party costs (permits, insurance, gateway fees, etc.) are excluded from refunds.
10) Transfers & Substitutions
Subject to availability and partner rules, you may request a date change or transfer your slot to another person before the cut-off stated in your invoice. Change fees may apply.
11) Participant Conduct
- Respect team decisions, local culture, wildlife, and Leave No Trace practices.
- Possession/use of illegal substances or unsafe behavior may lead to removal from the trip without refund.
12) Media & Image Rights
You consent to non-intrusive photography/video during the trip and grant us a non-exclusive right to use such media for trip documentation and marketing, unless you opt out in writing before start.
13) Personal Property
We are not responsible for loss/theft/damage to personal belongings. Carry valuables at your own risk and consider appropriate insurance.
14) Third-Party Services
We may use third-party transport, lodging, or logistics providers. Their services are subject to their own terms and availability. We are not liable for their acts/omissions beyond our reasonable control.
15) Liability & Indemnity
- To the maximum extent permitted by law, our aggregate liability for claims arising from a booking shall not exceed the amount you paid to us for that booking, except for liability that cannot be limited by law.
- You agree to indemnify us against claims arising from your breach of these Terms, misconduct, or inaccurate information supplied by you.
16) Privacy & Data
Your information is handled as described in our Privacy Policy. By booking/contacting us, you consent to necessary processing for trip delivery and communications.
17) Governing Law & Disputes
These Terms are governed by the laws of India. Parties shall first attempt amicable resolution; failing that, disputes are subject to the exclusive jurisdiction of the courts at Kolkata, West Bengal. (You may change the city to your preference.)
18) Miscellaneous
- Severability: If any provision is unenforceable, the remainder remains in effect.
- No waiver: Failure to enforce a provision is not a waiver.
- Assignment: You may not assign your rights without our consent.
- Updates: We may update these Terms; the latest version on this page applies.
19) Force Majeure & Rescheduling
- In the event of unforeseen circumstances such as war, geopolitical tensions, border closures, government restrictions, pandemics, natural disasters, or any force majeure situation, the expedition/program may be rescheduled or postponed.
- The safety of participants, staff, and crew remains the highest priority, and all decisions will be made in accordance with government advisories and ground conditions.
- No refunds will be issued for advance payments made under such circumstances.
- The advance amount will be securely retained and adjusted toward the rescheduled program.
- Participants will be provided with priority placement in the next available batch or rescheduled departure.
- The rescheduled program will be organized within a reasonable timeframe, depending on the normalization of conditions.
- In case a participant is unable to join the rescheduled dates, the amount may be:
- Transferred to another expedition/program, or
- Transferred to another participant (subject to company approval)
- Any additional costs arising due to rescheduling (such as permit revisions, transport changes, or logistic adjustments) may be borne by the participant, if applicable.
- The company will not be held responsible for additional personal expenses incurred due to postponement, including travel, accommodation, or gear rentals.
20) Summit Attempt & Re-attempt Policy
- Mountaineering is a challenging adventure activity, and summit success cannot be guaranteed due to factors such as weather conditions, health, acclimatization, and safety concerns.
- If a participant is unable to reach the summit during the expedition, they will be eligible for a special discount on the same expedition in the following season.
- The discount will be applicable only for the same peak/expedition and is non-transferable to other individuals.
- This offer is valid for one re-attempt in the immediate next season only.
- Participants must meet all fitness, eligibility, and documentation requirements again for the re-attempt.
- The discount will apply only to the expedition fee, and not to:
- Insurances
- Personal expenses
- Gear rentals or logistics upgrades
- The participant must inform the company in advance about their intention to rejoin the expedition to avail the benefit.
- All re-attempt bookings will be subject to availability of slots in the upcoming season.
- The company reserves the right to review and approve eligibility for the discounted re-attempt based on performance, conduct, and safety compliance during the previous expedition.
